These Terms of Service (“Terms”) govern your access to and use of the VarsityPlay website (the “Site”) and any purchases made through it. By visiting the Site and/or purchasing something from VarsityPlay (“we,” “us,” “our”), you agree to be bound by these Terms and by any policies referenced here, including our Refund Policy.

If you do not agree to these Terms, you may not access the Site or use our services.

1) Eligibility

By using this Site, you represent that you are at least the age of majority in your jurisdiction, or that you have the legal consent and supervision required for a minor to use the Site.

2) Changes to the Site or Terms

We may update or modify the Site, these Terms, and any policies at any time. Changes take effect when posted. Your continued use of the Site after changes are posted means you accept the updated Terms.

3) Products, Pricing, and Availability

All product descriptions, images, and specifications are provided for convenience and may be updated without notice. Colors and appearance may vary based on your device and display settings.

We reserve the right to:

  • Limit or refuse sales to any person, region, or jurisdiction

  • Limit quantities per order

  • Modify, discontinue, or change products at any time without notice

Prices are subject to change without notice. If we correct an error in pricing or product information after an order is placed, we may cancel the order and refund any amount charged.

4) Orders and Payment

By placing an order, you agree that:

  • You are authorized to use the payment method provided

  • The information you provide is accurate and complete

We may refuse, cancel, or limit any order for reasons including suspected fraud, unauthorized transactions, inventory issues, or errors. If we cancel an order after payment is captured, we will issue a refund to the original payment method.

5) Shipping and Delivery

Shipping times are estimates and not guaranteed. Delays may occur due to factors outside our control (carrier delays, weather, customs, etc.). Any delivery dates shown are estimates.

Risk of loss transfers to you when the order is delivered to the carrier, to the extent permitted by law.

6) Returns and Refunds

If there is a conflict between these Terms and the Refund Policy regarding returns/refunds, the Refund Policy controls.

7) Promotions and Discount Codes

Promotions and discount codes (if offered) are subject to their own terms and may be modified or discontinued at any time. Unless stated otherwise:

  • Codes cannot be combined

  • Codes do not apply retroactively to past purchases

  • Codes may exclude shipping, taxes, or certain products/collections

8) Account Responsibility (If Applicable)

If you create an account on the Site, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized access.

9) Prohibited Uses

You agree not to use the Site or its content:

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

13) Limitation of Liability

To the fullest extent permitted by law, VarsityPlay and its owners, employees, agents, contractors, suppliers, and affiliates will not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or related to your use of the Site or any products purchased through the Site.

Where liability limitations are not allowed, our liability is limited to the maximum extent permitted by law, and in all cases will not exceed the amount you paid to VarsityPlay for the applicable product(s) giving rise to the claim.

14) Indemnification

You agree to indemnify, defend, and hold harmless VarsityPlay and its affiliates, officers, directors, employees, agents, contractors, and suppliers from any claim or demand arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party rights.

15) Governing Law

These Terms are governed by the laws of New Jersey, United States, without regard to conflict of law principles.

16) Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforceable to the maximum extent permitted, and the remaining provisions will remain in full force and effect.
